General Terms and Conditions of Gipfel Deutschland GmbH
§1 Applicability to Entrepreneurs and Definitions
  1. The following General Terms and Conditions apply to all deliveries between us and a consumer in their version valid at the time of the order.
  2. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 BGB).
§2 Conclusion of a Contract, Storage of Contract Text
  1. In the event of a contract conclusion, the contract is formed with:

  1. The presentation of goods in our online shop does not represent a legally binding offer but a non-binding invitation for the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
  2. When an order is placed in our online shop, the following steps apply:
    • Selection of the desired goods
    • Confirmation by clicking the “Order” button
    • Verification of the items in the shopping cart
    • Clicking the “Checkout” button
    • Registration in the online shop with email and password (or guest checkout)
    • Review or correction of the entered data
    • Final submission of the order by clicking “Submit Order” or “Buy Now”

The consumer can return to the website where customer information is entered or correct errors using the “Back” button in their internet browser before submitting the binding order or cancel the ordering process by closing the browser. We immediately confirm receipt of the order through an automatically generated email (“Order Confirmation”), which constitutes acceptance of the offer.

  1. Storage of the contract text for orders in our online shop: We store the contract text and send the order details and our terms and conditions to you via email. You can view past orders in your account under “My Account” -> “My Orders.”
§3 Prices, Shipping Costs, Payment, Due Date
  1. The stated prices include statutory VAT and other price components. Additional shipping costs apply where stated.
  2. The consumer can pay in advance or by credit card (Visa, Mastercard, American Express).
  3. If payment in advance is selected, the consumer agrees to pay the purchase price immediately upon contract conclusion.
§4 Delivery
  1. Unless stated otherwise in the product description, all items offered are ready for immediate shipment. Delivery occurs within 5 working days. For advance payments, the delivery period begins the day after the payment is instructed to the transferring bank. For all other payment methods, it begins the day after contract conclusion. If the end of the period falls on a Saturday, Sunday, or public holiday at the delivery location, the deadline is extended to the next working day.
  2. The risk of accidental loss or deterioration of the sold goods transfers to the buyer upon receipt, even in the case of shipment purchases.
§5 Retention of Ownership

We retain ownership of the goods until full payment of the purchase price has been received.

§6 Consumer’s Right of Withdrawal

Consumers are entitled to a withdrawal right under the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

Withdrawal Policy

You have the right to withdraw from this contract within 14 days without providing any reason.

The withdrawal period is 14 days from the date on which you or a third party nominated by you (other than the carrier) takes possession of the goods.

by means of an unambiguous statement (e.g., a letter sent by post, fax, or email) about your decision to withdraw from this contract. You may use the attached sample withdrawal form, though it is not mandatory.

Effects of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than 14 days from the day we receive your notice of withdrawal.

We will use the same payment method for the reimbursement as you used for the initial transaction unless expressly agreed otherwise; no fees will be charged for this reimbursement.

We may withhold the reimbursement until we have received the goods back or you have provided proof of their return, whichever is earlier.

You must return or hand over the goods to us promptly and no later than 14 days from the day on which you notify us of the withdrawal. The deadline is met if you send the goods before the 14-day period expires.

We bear the costs of returning the goods.
